The person transferring the property (grantor) is simply giving up any rights they may have to the property, making no promises 

In Real Estate, a quitclaim deed is a legal document that transfers a property owner's interest (if any) in a property to another person without guaranteeing the validity of the title or offering any warranties. The person transferring the property (grantor) is simply giving up any rights they may have to the property, making no promises about ownership or potential legal issues tied to it. 


The recipient (grantee) receives whatever interest the grantor has but gets no legal protection against title defects or claims on the property.  


How a Quitclaim Deed Works

  • Grantor's Action: The owner (grantor) signs the quitclaim deed, transferring their interest to the recipient (grantee). 
  • No Guarantees: The grantor makes no promises about owning the property or if the title is clear of any legal issues, such as liens or prior claims. 
  • Recipient's Burden: The recipient must do their own due diligence to ensure the property's title is clear, as they are not protected by the deed itself. 
  • Official Record: The deed must be signed by the grantor, notarized, and then officially filed with the county clerk to make the transfer valid and publicly recognized. 

When a Quitclaim Deed is Used

Quitclaim deeds are useful in situations where there is a high degree of trust between the parties, and formal sales or title guarantees are not needed. Common scenarios include: 

  • Family Transfers: Transferring property between family members or partners who know and trust each other.
  • Divorce: One spouse transferring their interest in a jointly owned property to the other.
  • Adding a Name to the Title: Adding a child or sibling to a property's title.
  • Clarifying Title: Resolving issues or uncertainties on a property's title.
